US drug companies watching India, hopeful that Indian legislature fulfills its obligations
As this article reports, US drug companies are watching India in hopes that the Indian legislature meets an upcoming deadline to make Indian patent law fully TRIPs compliant.
India is a signatory
to the Agreement on Trade Related Aspects of Intellectual Property
(TRIPs) and is nearing the end of a ten year grace period for achieving full compliance. India has made previous amendments to its Patents Act aimed at satisfying portions of its
TRIPs obligation. But, the most significant amendment has been saved
for last. By January 1, 2005, the Indian Patents Act must be
amended to extend product patent protection to food, chemicals, and
pharmaceuticals.
